Author : Firman Arifandi, LL.B., LL.M.
One of the main purposes of marriage is to justify the relationship between a man and a woman. Equally important, the benefits of marriage are also mentioned in the Qur'an that with it humans are expected to be able to achieve a sakinah or peaceful life on the basis of love and compassion, as recommended by Allah SWT in Surat Ar-Rum, 21:
And among the signs of His power is that He has created for you wives of your own kind, so that you are inclined to and feel at ease with him, and He made them between you with love and affection. Indeed, in that there are signs for people who think. (Ar Rum: 21)
It is interesting to study in more detail, it turns out that in order to achieve a sakinah marriage, it must go through the procedures and rules that have been stipulated in the Shari'a in order to get the blessing of Allah SWT.
The existence of legal and harmonious conditions in marriage itself is so that humans do not fall into mistakes and tyranny in it. The fulfillment of the pillars of marriage results in the recognition of the validity of the marriage both according to religion and government (compilation of Islamic law). But if it's the other way around, it will result in the invalidity of the marriage.
The scholars then classify the types of marriage that are forbidden in Islam by departing from a number of good arguments in the Qur'an, Sunnah, and Ijma'. There is a type of mut'ah marriage whose purpose is often just to have fun, there is also tahlil marriage which is considered a planned deviation in the chapter on marriage, then there is also syighar marriage which is often very similar in practice to a conditional barter system.
