This Android application is an Explanation of Halal-Haram Marrying Adultery and Pregnant Women by Aini Aryani, Lc. In PDF format.
Halal-Haram Marrying Adultery and Pregnant Women
Adultery is an unlawful act, which carries punishment in the world in the form of 100 lashes for those whose status is ghairu muhshan, and the death penalty by stoning (stoning) if their status is muhshan. Meanwhile, in the afterlife, of course, you will have to wait for a painful punishment, because the sin of adultery is a big sin.
But apart from the prohibition of adultery, the sin and the punishment, does the act of adultery that has already been committed then forbids marriage? That is, is a person who has committed adultery punished by not being able to marry?
Indeed, there are many people who think that way. And that assumption is not wrong. It's just that if we broaden the horizons of our knowledge, especially in the field of jurisprudence muqarin alias comparative jurisprudence, we find that the majority of scholars such as the schools of Al-Hanafiyah, Al-Malikiyah, Asy-Syafi'iyah and Al-Hanabilah even allow marriages that are committed by a person who has committed adultery.
Indeed, there is an opinion that marriage is forbidden for adulterers, such as the opinion that is said to be quoted from Aisyah, Ali bin Abi Talib, Al-Barra` and Ibn Mas`ud ridwanullahi alaihim ajma'in.
Then they base it on the prohibition in the following verses of the Koran:
Men who commit adultery do not marry except women who commit adultery, or women who are polytheists; and women who commit adultery are not married except by men who are adulterers or men who are polytheists, and that is forbidden for believers. (QS. An-Nur: 3)
