Provisions of Al-Quran Inheritance of Husband and Wife
The problem of property ownership between husband and wife continues until death comes to pick up, namely the problem of inheritance law.
1. Husband Died
If the husband dies leaving his wife, then the wife becomes the heir to her husband. The wife gets a certain value from her husband's property, sometimes getting 1/8 part but can also get ¼ part. Depending on whether the deceased had far' heirs or heirs, that is
- Boy
- Girl
- Grandson (from the line of sons)
- Granddaughter (from the line of daughters)
If the existence of one of the far' heirs is confirmed to be valid where he also receives the inheritance, then the wife's rights are only 1/8 of the share. On the other hand, if the deceased does not have one of the above inheritance far', then the wife will get a bigger share, which is ¼ part.
All of this has become a decree from Allah SWT directly, as stated in Al-Quran Al-Karim in the following verse:
"And they get 1/4 of what you leave if you don't have children. If you have children, then the wives get one-eighth of the assets you leave after fulfilling the will that you made or (and) after paying your debts. ( QS. An-Nisa': 12)
