This question is almost always asked. And the answers of each ustadz, almost all are different. Why? Because in this case, the fiqh scholars of different schools of thought do have different opinions.
A. One Verse Different Legal Conclusions
The root of the difference lies in the differences in the scholars of the four schools of thought in drawing legal conclusions from QS. Al-Maidah verse 6, which reads:
"... or you have touched a woman, then you do not find water, then do your prayers with good (holy) soil..."
Literally, the verse states that touching a woman causes ablution to be broken, so she is ordered to find water to perform ablution again, and if she does not find water, she is ordered to perform tayammum.
However, the verse above does not explain in detail regarding:
- Which woman if touched makes a person's ablution null and void?
- The woman who is his mahram or not?
- Women who are baligh or not?
- Who if touching a woman can break ablution?
- Which part of a woman's body can break ablution if touched? Just the skin or the teeth and hair as well?
These things make the scholars draw different conclusions from QS. Al-Maidah verse 6 above. Of course with the istimbath ahkam method that is owned by each madzhab.
