Qiyas Fourth Source of Sharia Law
The sources of Islamic law are not limited to the Al-Quran and Sunnah. Even though we agree that the Al-Quran is revelation and As-Sunnah also comes from revelation, in reality when we draw legal conclusions, there are still many sources of law outside the Al-Qura and As-Sunnah.
Actually there are two more main sources, namely Ijma' and Qiyas. And in fact there are many other sources of law such as Al-Mashalih Al-Mursalah, Al-Istishhab, Saddu Adz-Dzari'ah, Al-'Urf, Qaul Shahabi or mazhabu Ash-Shahabah, Amalu Ahlil Madinah, Syar'u Man Qablana, Al-Istihsan, Al-'Urf and others.
But these four namely Al-Quran, As-Sunnah, Ijma and Qiyas are sources of law that have been unanimously agreed upon by all scholars and all schools of thought. Although in implementing it they could be different. These four are referred to as mashadir as-syaria al-muttafaq 'alaiha
Why do we discuss this Qiyas specifically?
Because Qiyas has some uniqueness that the other three sources don't have, namely Qiyas is not limited by space and time.
Let's compare it with the Koran. Even though the Al-Quran is a revelation that descends from the sky and has a high degree, in its implementation, the movement of the Al-Quran is limited by space and time.
- First: the number of verses in the Al-Quran cannot be increased anymore, since Rasulullah SAW passed away leaving us all. Only around 6,200, where the details of the scholars differed.
- Second: Al-Quran only descended around Mecca and Medina. No verses from the Koran were revealed in London, Paris, New York, Aussy or Depok Bekasi. So in naming verses, we only know Makkiyah and Madaniyah verses. There are no Londoniyah, Parisiyah, Depokiyah verses.
Even though the da'wah mission of Rasulullah SAW was not limited by the geographical boundaries of the Arabian Peninsula. And valid until the Day of Resurrection. Until today, we have lived through 15 centuries, aka 1400 years.
