The marriage contract as a bond between two parties and also a type of worship in Islam, has several sharia provisions which are the cause of the validity of a contract or the perfection of the quality of the reward of worship.
The scholars at least stipulate three elements of law in a marriage.
The first is the pillars of marriage, which are the cause of the validity of a marriage. Where the majority of scholars are of the opinion that there are four pillars of marriage, namely: (1) the bride and groom, (2) shoghoh/qabul consent, (3) female guardian, and (4) two witnesses.
Second: compulsory marriage, which is something that must be fulfilled in marriage. Where if it is not fulfilled, then the marriage is still valid as long as the pillars are perfect, but it can result in sin if abandoned by the party who is required to carry out the obligatory marriage. In the case of this marriage, what is meant by compulsory marriage is the giving of a dowry by the man to the woman.
Third: the sunnah of marriage, namely things that complement the quality of worship in marriage. And included in the sunnah of marriage are the recommendations of the Shari'a in marriage which are neither pillars of marriage nor obligatory of marriage. Such as holding a walimah, choosing Friday to carry out the marriage contract, and other sunnahs.
In this booklet, the author will limit the discussion of this family fiqh series to discussing the obligation of marriage, namely the provision of dowries.
